John P. Boggs, esq. received his undergraduate degree from Brigham Young University and received his Juris Doctorate from University of the Pacific, McGeorge School of Law, where he graduated with great distinction and was selected Order of the Coif.  During law school, Mr. Boggs served as Primary Editor of the Transnational Lawyer.  Prior to establishing Fine, Boggs & Perkins llp, Mr. Boggs was with a national law firm representing management in all aspects of labor and employment law.  Among various other responsibilities, Mr. Boggs was in charge of civil litigation for a nationwide insurance company underwriting auto dealers, as well as various other insurance carriers offering employment practices liability insurance to auto dealers and other clients.

Mr. Boggs has defended numerous large class-action employment lawsuits as well as numerous other litigation matters.  He provides preventive training to numerous businesses, as well as trade organizations such as the California New Car Dealers Association and CNCDA FormSource.  He also advises clients on a wide variety of employment issues, including, pre-employment screening, employee terminations, employment agreements, discrimination and harassment, the Americans with Disabilities Act, the Family and Medical Leave Act, wage and hour laws, collective bargaining negotiations, drug and alcohol testing, workers’ compensation issues, and various other employment-related state and federal laws.  He has assisted employers in developing, implementing, and analyzing employee handbooks, personnel policies, such as sexual harassment policies, and discipline and discharge procedures.  He has been lead counsel in briefing and arguing various cutting-edge employment arbitration appellate decisions, as well as both California and United States Supreme Court Amicus Briefs.

Mr. Boggs is also currently a professor of Employment Law at the University of Nevada Las Vegas.

Topic: WAGE WAR

Topic Description: At its heart, the essence of the employment relationship is that the employee performs work under the control of the employer in exchange for compensation. California has more employee-friendly (anti-employer) wage/hours laws than any other state. California allows one employee to file claims on behalf of all employees and provides a “bounty” for doing so. It should surprise no one that issues relating to compensation make up a significant share of employment disputes and regulations. Meal and Rest Periods are the most popular lawsuit and until now the most difficult to handle – come learn how to fix it with new options.

 KPA’s F&I District manager Aaron has worked in many positions within the Automotive industry for last 15+ years. His focus during those various positions has been on customer retention and operational efficiency. He leads a team of 12 auditors across eight states. His team provides onsite audits and reviews for dealers covering Federal Regulations and State Vehicle code and Civil codes regulations.

Adam D. Hermes is the Fraud Investigations Manager of Comerica Incorporated and Comerica Bank. He oversees a team of investigators in multiple states conducting a diverse range of financial crime investigations, including cyber-enabled crime, wire fraud, check fraud, embezzlement, and money laundering.

Adam joined Comerica in 2002 and has held various roles within retail banking, compliance, and financial crime investigation.  Before joining Comerica, Adam served in the US Navy with the Naval Nuclear Propulsion Program, operating the nuclear plant onboard the aircraft carrier USS Theodore Roosevelt during Operation Allied Force and Operation Southern Watch. Adam holds a Bachelor of Business with a Concentration in Finance from the University of Phoenix. He is a Certified Fraud Examiner and Certified Anti-Money Laundering Specialist. Among his professional and community affiliations, Adam is a member of the Association of Certified Fraud Examiners, Association of Certified Anti-Money Laundering Specialists, and serves on the Executive Board of the Michigan Chapter of ACAMS as its Membership Director.

Jim Potts

Jim has been assisting and representing employers of all sizes and industries in the field of human resources for thirty-five years. Throughout his professional career he has attained a Bachelor of Arts Degree, Juris Doctorate Degree, Real Estate Brokers License, and is also former a Reserve Captain with the Los Angeles County Sheriff’s Department, a certified Mediator through the Los Angeles County Bar Association and a former Master Teacher for the University of Phoenix having taught on the graduate and undergraduate levels. His course curriculums included, but were not limited to, Business Law, Employment Law, The Legal Aspects of Supervision, United States Constitutional Law and Ethics. Rounding off Jim’s career highlights he is also an author having published his first book In July 2008 (Right to Counsel) and a second one in November 2013 entitled “Walking on Eggshells” a manager’s handbook on managing a minority workforce. Jim’s third book, “A Matter of Principle” is currently in it’s first editing and is expected out after the first of the year. Halbert “Bert” Rasmussen has been practicing law on the dealer side for over 30 years. He has delivered wins for his clients on such matters as franchise disputes, including terminations instituted by manufacturers, complex multi-party claims arising out of dealership buy-sell agreements, and breach of contract matters, among others. He uses his franchise and distribution law skills to help clients meet their goals, avoid litigation, and maintain harmonious relations with their franchisors. He has extensive experience representing car, truck, bus, and motorcycle dealers in most legal issues they face. He Rasmussen also defends clients when they are accused of violating regulatory requirements, and helps them with policies and procedures to achieve regulatory compliance. Rasmussen’s experience also extends to negotiating agreements with manufacturers, realty owners, and lenders as well as mergers and acquisitions and consumer and business litigation.


Topic: “TAKING STOCK OF DEALER FRANCHISE RIGHTS – PAST, PRESENT, AND YET TO COME

Topic Description: A review of dealer franchise rights with a focus on the development of California law over the past 30 years, including a look at a currently proposed expansion of those right as laid out in Assembly Bill 473. Issues covered include protests, prohibited contract requirements, prohibited facilities requirements, and prohibited incentive requirements.
